Terms of Service

These Terms of Service ("Terms") constitute a binding agreement between you ("Subscriber", "you") and ScanFood.AI ("Service Provider", "we", "us") governing your use of the ScanFood.AI service ("the Service").
By launching the Telegram bot, pressing the START button, or making a payment, you accept these Terms in full. If you do not agree, please discontinue use of the Service.
1. Definitions
- Service — a software platform for tracking nutrition, controlling food quality and quantity, calculating calories and macronutrients (protein, fat, carbohydrates), and maintaining a food diary. Accessible via the Telegram bot.
- Telegram Bot — the software application within the Telegram messenger, located at @ScanFoodAI_bot.
- Website — the web pages at https://scanfood.ai and its subdomains.
- Subscription — paid access to the Service for a specified period according to the selected plan.
- Plan (Tariff) — the pricing and duration of access as set by the Service Provider, which may be changed at the Service Provider's discretion.
2. Subject of the Agreement
The Service Provider grants you access to the Service under a simple (non-exclusive) license in the following forms:
- Free Trial — full free access for 3 (three) days without requiring a Subscription.
- Paid Subscription — after the trial period, continued access requires payment according to the selected Plan.
This agreement covers all existing features of the Service, their modifications, and any new features added in the future.
3. Access and Registration
You gain access to the Service by connecting to the Telegram bot and pressing the "START" (/start) button. Upon first connection, the bot may request information to create your personal profile and provide individualized recommendations.
The following data may be collected during use:
- Chat ID — for user identification
- Age, gender, height, weight, activity level — for calculating calorie and macronutrient targets
- Goal (weight loss, maintenance, or gain) — for personalization
- Analysis history — for maintaining the food diary
4. Payment Terms and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
- Subscription fees are charged in advance for the selected Plan period.
- All payments are processed by Paddle. Paddle determines, collects, and remits applicable taxes on your purchase.
- Access to the Service is granted automatically upon payment confirmation.
- Your purchase is also governed by Paddle's Checkout Buyer Terms.
- Charges on your bank or card statement will appear as "PADDLE.NET * SCANFOOD".
5. Recurring Payments
By making your first payment, you consent to automatic recurring charges from the specified payment method for subsequent subscription periods upon expiration of the current paid period.
You may cancel automatic recurring payments at any time using the "Cancel Subscription" button in the Telegram bot settings, or through the subscription management link in your Paddle receipt.
6. Subscriber's Obligations
You agree to:
- Pay for Subscription services in full prior to the start of the service period
- Monitor automatic recurring charges and disable them when necessary
- Provide accurate information required for Service delivery
- Monitor updates to the Terms and related materials published in the Telegram bot
- Not reproduce, distribute, publicly display, or otherwise use any intellectual property accessible through the Service
- Use the Service solely for personal, non-commercial purposes
- Not redistribute, resell, sublicense, or provide third-party access to the Service
- Ensure you have the necessary devices, internet access, and software (including Telegram)
7. Subscriber's Rights
- Access the Service free of charge during the trial period
- Receive the subscribed Service upon payment
8. Service Provider's Obligations
The Service Provider undertakes to:
- Provide remote access to the Service
- Ensure effective operation of the Service
- Notify Subscribers of scheduled maintenance and service interruptions
- Address technical issues and implement improvements where feasible
- Provide relevant information related to the Service upon request
9. Service Provider's Rights
The Service Provider reserves the right to:
- Refuse service in cases of ethical or legal violations, or for organizational reasons
- Suspend or terminate access if the Subscriber violates these Terms
- Modify the service description, features, or pricing at any time without prior notice
- Engage third parties to fulfill its obligations under this agreement
10. Cancellation and Refunds
To terminate this agreement, you may unsubscribe from the Subscription via the Telegram bot or through the subscription management link in your Paddle receipt.
- If a new paid period has begun and you have not cancelled, the Subscription renews automatically.
- We offer a 30-day money-back guarantee. If you are not satisfied, you may request a full refund within 30 days of purchase.
- All refunds are processed through Paddle as the Merchant of Record.

11. Intellectual Property
The Service Provider holds all exclusive rights to the Website, Telegram bot, Service, and all associated components. These Terms do not transfer any intellectual property rights to you.
You are granted a non-exclusive license to use the Service for personal purposes only. This license becomes effective upon gaining access to the Service.
You may not:
- Modify, translate, reverse-engineer, copy, or create derivative works based on the Service
- Use automated tools, scripts, or bots to access or scrape the Service
- Use the Service for commercial purposes or profit extraction
- Attempt to interfere with the technical operation of the bot or Service
- Circumvent the navigation structure to access restricted content
12. Disclaimer of Warranties
The Service is provided on an "as is" basis. You acknowledge that the Service may contain errors.
- The Service Provider makes no guarantees that the Service will meet your specific goals or expectations.
- Nutritional estimates are approximate and generated by artificial intelligence. They should not be used as a substitute for professional medical or dietary advice.
- No information, materials, or guidance provided through the Service constitutes a warranty or guarantee.
- You assume full responsibility and risk associated with using the Service.
- The Service Provider is not responsible for any health consequences resulting from use of the Service. We recommend consulting a healthcare professional before making dietary changes.
13. Limitation of Liability
- The Service Provider's liability under any circumstances is limited to the cost of your current Subscription.
- The Service Provider is not liable for access issues caused by your actions (account deletion, Telegram errors, etc.).
- The Service Provider is not liable for failures of third-party services, including payment systems, banks, hosting providers, telecom operators, or data centers.
- The Telegram bot may contain links to third-party resources. The Service Provider is not responsible for the content, accuracy, or security of external websites.
14. Payment Security
All payments are processed by Paddle, which is fully PCI DSS compliant. When paying by card, you are redirected to Paddle's secure checkout page.
ScanFood.AI does not receive, store, or have access to your credit card numbers or payment details. All payment data is handled exclusively by Paddle on secure pages protected by SSL encryption. For more information, see Paddle's Privacy Policy.
15. Force Majeure
Neither party shall be liable for failure to perform obligations due to force majeure circumstances that could not be foreseen or prevented. If such circumstances persist for more than 30 days, either party may terminate the agreement unilaterally.
16. Dispute Resolution
All disputes shall be resolved through negotiation. If negotiation fails, disputes are subject to court proceedings. A mandatory pre-trial claim procedure is required before filing a court action.

17. Modifications to These Terms
The Service Provider may modify these Terms at any time without prior notice. The current version is published on the Website and in the Telegram bot. Continued use of the Service after changes constitutes acceptance of the updated Terms.
